FICTION WRITERS BEWARE! LIBEL IN FICTION CASES

As far back as the 1970s, there have been lawsuits in which the creators of fictional stories have been sued for their negative depiction of real people in the author’s life. Here are some of the more high-profile cases:

2009. Vickie Stewart successfully sued her longtime friend, the author Haywood Smith. Stewart claimed that Smith’s fictional character SuSu in the novel The Red Hat Club too closely resembled the real-life Stewart. And this character falsely portrayed Stewart as an alcoholic slut. The court ruled in favor of Stewart, and Smith was forced to pay $100,000 in damages.
